Temporary Suspension of Enforcement of Certain Provisions of OAC Rule 4757-5-13 (Teletherapy)

 

To support client care and to assist licensees in implementing certain provisions of OAC Rule 4757-5-13 (effective 10/12/2020) that went back into effect when Governor DeWine lifted the emergency order regarding COVID-19, the CSWMFT Board voted to temporarily suspend enforcement of the following provisions of Rule 4757-5-13 for a 90-day period beginning today, June 26 and ending on Friday, September 24, 2021:

  1. Requirement to hold an initial face to face meeting (in-person or via video).
  2. Requirement to obtain written consent prior to treatment.
  3. Use of a HIPAA-compliant platform that exceeds current U.S. Department of Health and Human Services guidance regarding remote communications during the federal COVID-19 nationwide Public Health Emergency.

This is a temporary suspension of enforcement to provide CSWMFT licensees sufficient time to implement all provisions of OAC Rule 4757-5-13.  The suspension of enforcement should not be considered a permanent change to the Rule. Licensees should begin the process of complying with OAC 4757-5-13 as soon as possible. This includes establishing plans to:

  1. See new clients initially via a face to face (in-person or video) appointment prior to starting treatment via the phone (if appropriate for the client).
  2. Obtain written consent from new clients prior to treatment.
  3. Use HIPAA-compliant platforms.
