New Status on License Verification

The status "Active in Renewal" on the licensure system has created much confusion. That status meant a licensee was eligible to renew, but not necessarily active, you had to check the dates. Our IT folks have created a new status "Failed to Renew" for late renewals, which is an eligible status for renewal, but you no longer need to check dates. Failed to Renew is very clear and now Active in Renewal always means active.

New Fees Including Late Renewal Fee

Part of House Bill 1, which is the Ohio budget bill for Fiscal years 2010 & 2011 included language that added new fees for the board. The new fees are authorized to be established by rule. Rule 4757-1-05 will be effective 10/18/2009 and adds the following new fees:
1. Late renewal fee of $40 for all licensees and $20 for Social Worker Assistant registrants.
2. License verification fee $25 for written confirmation of licensure to other entities.
Online renewal will automatically charge teh late fee if it applies.

Statute & Rule Changes for MFTs

The MFT statute change is effective 4/7/2009 and the rule changes are effective 4/18/2009. In order for MFTs to bill Medicare & Medicaid ODMH has to change their rules, which are in progress additionally the FEDs need to approve those changes to Ohio's billing. We are hoping for a July approval for both.

Several rule changes have been approved through the state's rule making process and are effective 11/2/2008. They are available at the top of the page using the link on the left to "laws and regulations". Supervision Changes

PCC applicants for supervision designation who apply no later than 8/31/2008 and send proof of 10 hours of supervision CEUs no later than 8/31/2008 are eligible to supervise counselor trainees and clinical residents while the board is processing their applications: Link. All online applications received by 8/31/2008 will be posted as pending by close of business 9/2/2008.

LISW applicants for supervision designation who apply no later than 8/31/2008 and who's status shows as pending are eligible to supervise social worker trainees and social workers gaining supervised experience toward their LISW license while the board is processing their applications: Link. All online applications received by 8/31/2008 will be posted as pending by close of business 9/2/2008.

Criminal Record Checks
The Ohio legislature passed House Bill 104, which was signed in to law by Governor Strickland in December. That statute change goes into effect on 3/24/08. All applications received on or after 3/24/08 will require a criminal records check prior to approval. See this link for more complete information: Link.

Social Worker Training Supervision Changes

Rule 4757-23-01 has been changed to require LISW's providing training supervision for LSWs to have a supervision designation after 8/31/2008. All existing LISWs are eligible to apply until 8/31/2008 without additional training. All applications for supervision designation after 8/31/2008 will require nine CEU hours in supervision as outlined in rule 4757-23-01. Counselor Supervision Changes

Rule 4757-17-01 has been changed in a number of areas.
1. Applicants for supervision designation after 8/31/2008 will need 24 hours of CEUs that meet the requirement in the rule
2. Applicants for supervision designation after 8/31/2008 will need at least one supervision of supervision experience, which has been supervised for a minimum of five hours and consists of the applicant providing ten hours of supervision to at least one supervisee.
3. Counselors holding the supervision designation may meet three of the six required CEU hours in supervision through a minimum of six hours of peer supervision, which shall address one or more core supervision content requirements and shall be with other licensed mental health providers, and shall be documented as such, including participants' names, topics discussed and dates met.
4. Supervisors may have up to six training supervisees at one time.

Continuing Education Changes

The Board was reviewing Post Approval CE requests and the issue of in-state post approvals was addressed. By practice the Board has approved in-state post approval for first time renewals, however the rules do not support that practice. The Board by motion set December 31, 2005 as the final date to accept in-state CEU approvals.

Legislative Issues

Representatives Webster & Letson introduced House Bill 427 to correct the statute definition of the practice of marriage and family therapy. The bill has passed the house and the Senate. The bill was signed by Governor Strickland on January 7, 2009. We adopted rules through the normal rule making process as has ODMH, which adds MFTs to the provider rules in order that MFTs may work and bill for services at County funded agencies.
